PHILLIPS LYTLE LLP PARTNERS KEVIN J. MULVEHILL AND LINDA T. PRESTEGAARD WILL SPEAK AT THE ROCHESTER BUSINESS ALLIANCE BUSINESS BRIEFING 

Rochester, N.Y. – Kevin J. Mulvehill and Linda T. Prestegaard, partners with Phillips Lytle LLP, a premier regional law firm that is recognized nationally for its legal excellence, will be featured speakers at the Rochester Business Alliance (RBA) Business Briefing on April 17, 2015.

Mr. Mulvehill and Ms. Prestegaard will address the topic “Top Trending Issues in Wage and Hour Law.” In this presentation they will discuss a variety of state and federal labor law items including proposed amendments to the federal exemption criteria, employee misclassification, independent contractors, the use of interns, the Wage Theft Prevention Act, training, off-the-clock and after-hours work, as well as other relevant wage and hour law issues.

The Business Briefing will take place at RBA offices, 150 State Street, 3rd Floor, Rochester from 8 a.m. to 9 a.m. The briefing is open to RBA members only.

Mr. Mulvehill concentrates his practice in commercial litigation, labor and employment litigation, and counseling and representing public and private sector employers in all areas of labor and employment law.

His areas of focus include: compliance with state and federal labor and employment laws; wage and hour law; employment hiring, discipline and termination; reductions in force; employee leave issues; work rules; personnel policies and practices; non-compete agreements and other restrictive covenants; employment contracts; employment discrimination; labor arbitrations, unfair labor practices and other labor matters; workplace investigations; and employee training.

He received his B.S. from Cornell University, and his J.D. from State University of New York at Buffalo School of Law. In addition, Mr. Mulvehill studied comparative law at Université Robert Schuman, Strasbourg School of Law, France.

Mr. Mulvehill received the Erie County Bar Association’s Volunteer Lawyers Project 2013 Pro Bono Award for his work on the Immigration Project. He was recognized by the New York State Bar Association’s Empire State Counsel® Program for Pro Bono Work, and was cited as an “Up & Coming Attorney” by The Daily Record, in 2011.

He is a member of the Cornell Club of Rochester, and the Rochester Rotary Club.

Ms. Prestegaard concentrates her practice in the area of labor and employment law advising employers on the full range of employment and workplace issues. She represents employers in federal and state courts and agency proceedings defending Title VII, ADA, ADEA, FMLA and Human Rights Law claims. Ms. Prestegaard handles wage and hour collective and class actions under the FLSA and New York Labor Law as well as investigations and actions by the United States and New York State Departments of Labor.

She has represented higher education institutions with her work on faculty tenure and contract disputes, investigations of claims of misconduct and civil rights violations, regulatory compliance, faculty and staff handbooks, appointment letters, and affirmative action plans. Ms. Prestegaard also represents management in traditional labor law matters including conducting training regarding concerted activity, union awareness and campaigns, collective bargaining, labor arbitrations, NLRB proceedings, and LMRA litigations. She also has extensive experience investigating claims of harassment, discrimination, and workplace misconduct.

She also conducts training on avoiding sexual and other harassment in the workplace, wage and hour compliance, human resources best practices, and other workplace issues.

She earned her J.D. from Cornell Law School and a B.A., magna cum laude, from Tufts University.

Ms. Prestegaard was named to Upstate New York Super Lawyers® 2012 and 2013 lists of Top 25 Women Lawyers, as well as, the 2007-2014 Upstate New York Super Lawyers® lists. She is also named to The Best Lawyers in America® list.
