Anna Mercado Clark served on the panel, “They’re After Us All! How to Keep Yourself and Your Clients Safe from the Grasp of International Organized Crime,” at the American Bar Association International Law Section’s 2023 Annual Conference. She joined other panelists to discuss how firms can keep themselves and their clients safe from international organized crime.

 

 

“Resolving Disputes Internationally: The Impact of Cultural Diversity”

We are accustomed to things being done the way they have always been done in our own jurisdiction. When lawyers step into an international dispute resolution forum and encounter participants from a different background who have always done things differently, there is a risk of culture shock. There may also be a tendency towards an implicit bias that “different” must be “wrong.” In international arbitration and mediation, there are a wide range of cultural factors to consider. Many are absent in domestic litigation. Litigators’ expectations of procedure and etiquette may diverge.

Eoin Ó Muimhneacháin served on the panel, “Resolving Disputes Internationally: The Impact of Cultural Diversity,” at the American Bar Association International Law Section Annual Conference, which used real life-based scenarios to help attendees learn what to avoid and how to work with parties, counsel, experts, translators, arbitrators and/or mediators from different jurisdictions, legal traditions and backgrounds.
