James O’Connor provided a legal update for the Buffalo Niagara Human Resources Association (BNHRA) at its June 2025 meeting. Since the last Phillips Lytle Legal Update, there have been several important changes on both the federal and New York State employment law fronts that directly impact HR compliance, policies and day-to-day operations.
On the federal side, the session covered recent changes to the composition and direction of the EEOC and NLRB.
At the New York State level, the latest budget brought substantial changes, including:
1. Expanded enforcement authority for the Department of Labor (DOL) over unpaid or untimely wages.
2. New requirements for minor employment certification and employer recordkeeping.
3. Increased civil penalties for child labor violations.
4. Clarification of employee damages for New York pay frequency claims.
