H-1B Executive Order To Take Effect At Midnight: Any H-1B Workers Outside the U.S. Should Return Immediately

On Friday night, September 19, 2025, the Trump administration published an executive order requiring that all H-1B visa petitions be accompanied by a $100,000 fee. The order takes effect at 12:01 a.m. on 9/21/25 and bars the entry to the U.S. of any H-1B workers whose employer has not yet paid the $100K fee on their behalf.

Any H-1B workers who are currently outside the U.S. should return TODAY. Anyone who is in H-1B status should not leave the U.S. for any reason.
