On December 29, 2025, the U.S. Department of Homeland Security (DHS) published a Final Rule implementing, without change, the Notice of Proposed Rulemaking published on September 24, 2025. We previously published an article regarding the changes proposed by that rule. As there were no substantive changes to the Final Rule, that summary remains accurate. The Final Rule will go into effect within 60 days of publication, and will therefore be in effect in March 2026 for the Fiscal Year 2027 H-1B lottery.
