Under the Congressional Review Act (CRA), federal agencies must submit a report on a new rule to both houses of Congress and the Comptroller General before it can take effect. June’s restructuring of BEAD’s rules meets the definition of a rule, according to the Government Accountability Office (GAO). David Bronston said GAO’s decision likely isn’t enough to do away with changes from the June policy notice, but it could provide “ammunition” to lawmakers or litigants who want to roll them back.
