Marc has more than 35 years of experience litigating complex matters in state and federal courts, in arbitration and mediation, and before administrative agencies.

Marc’s vast experiences representing individuals, businesses and insurance carriers makes him uniquely qualified to understand the different perspectives of both sides and the emotional, financial and legal obstacles that keep them from resolving their disputes. Most importantly, he knows how to help conflicting parties overcome those obstacles.

Marc approaches litigation matters as a trusted adviser offering clients practical and timely advice in his varied commercial and civil litigation practice involving chemical exposure and toxic torts; workplace accidents and wrongful death litigation; product liability; employment disputes; construction disputes; breach of contract; fraud;, business torts; personal injury; real estate disputes; defending municipalities, county jails, sheriff departments and other public agencies concerning 42 U.S.C. Section 1983; and vehicle and traffic matters.

Additionally, Marc lectures on litigation and estate planning matters, and is a court-approved mediator for the United States District Court, Northern District of New York.

Experience

Representative Matters
  • Syverson v. Consolidated Rail Corporation – Successfully defeated defendant’s motion for summary judgment seeking dismissal of the action and obtained a favorable settlement avoiding the necessity of a trial.
  • Ford Motor Credit Company LLC v. Orton-Bruce – Successfully obtained partial summary judgment against defendant on breach of contract claim.
  • Bruno v. County of Schenectady, et. al. – Successfully obtained order dismissing claims against county defendant.
  • Represented a wind farm developer against dozens of tort claimants living in the vicinity of the wind farm who sought $20 million in punitive and other damages sounding in nuisance, trespass and negligence for various alleged health effects due to their proximity to wind turbines; secured voluntary dismissals of certain claims on the merits and a very favorable resolution disposing of all other claims.
  • Obtained dismissals for a major utility in numerous automobile, truck, bicycle and motorcycle accident cases.
  • Defended a manufacturer of electric space heaters against alleged damages in excess of $60 million, that a heater had malfunctioned so as to induce heat stroke and cause catastrophic brain injuries to an infant plaintiff. Administered the fact investigation, conducted extensive discovery and coordinated a team of compelling experts on issues of general and specific causation that supported a favorable settlement for the client.
  • Castro v. TCA Logistics Corp., et al., – Successfully represented defendants in obtaining an order compelling plaintiff to arbitrate his claims that he was improperly classified as an independent contractor. After claimant commenced arbitration the case resolved on favorable terms.
