Non-compete Agreements Face Ban, but Legal Fight Kicks Off

Existing non-compete agreements could no longer be enforced.

In April 2024, the Federal Trade Commission voted 3-2 to ban nearly all non-compete agreements, but the U.S. Chamber of Commerce has filed suit against the FTC. Supporters of these agreements say it’s a way to protect employers from losing a competitive advantage when workers depart an employer, while opponents argue the agreements unfairly restrict employees’ opportunities and earning.

Ryan Lema was interviewed for an article that appeared in The Buffalo News titled, “Buffalo Next: Non-compete agreements face ban, but legal fight kicks off,” where he discussed the basics of a non-compete agreement, including who they are targeted towards and when they are deemed unnecessary.
