New York’s Unified Court System has adopted a new rule governing attorneys’ use of generative AI in legal drafting. The rule allows lawyers to use AI tools to prepare motion papers, briefs, and pleadings without requiring special disclosure, but it makes attorneys fully responsible for verifying the accuracy of all AI-generated content.
Anna Mercado Clark was quoted in the article, describing the rule as much less restrictive than other local rules across the country. She also noted that lawyers already have an ethical obligation to ensure accuracy, so this is just another reminder to uphold that obligation.
