East Buffalo residents continue their fight against the $1 billion Kensington Expressway project by filing numerous lawsuits to stop construction, including challenging federal involvement in the project, a declaratory judgment action in NYS Supreme Court, and three Article 78 proceedings, in addition to an injunction to stop the letting of contracts.
Alan Bozer was quoted in this WBEN article as the attorney representing the coalition. He says, “The State Department of Transportation violated the law by not conducting a full Environmental Impact Statement addressing all of the effects of the proposed four-and-one-half years of heavy construction, blasting noise, noxious fumes….”
