New York State act requiring only electricity in new buildings has been delayed.

The All-Electric Buildings Act was slated to take effect January 1, 2026, which would have banned the use of natural gas and other fossil fuels in new construction of less than seven stories high. The requirement led to a lawsuit filed by trade groups and labor unions claiming it’s pre-empted by federal law.

Dennis Elsenbeck was quoted in a Buffalo News article that it places a burden on developers that wish to develop disadvantaged communities but that the electric infrastructure cannot sustain it.
