Todd Ritschdorff

A problem solver and resourceful creditors’ rights lawyer with nearly two decades of experience, Todd represents creditors in all aspects of their business, both in and out of court.

Todd concentrates his practice in bankruptcy and creditors’ rights, regularly assisting lenders and equipment lessors in workouts and forbearance transactions, restructurings, asset recovery and disposition, commercial collections and multistate judgment enforcement. In his practice, Todd has also handled a variety of matters including breach of contract and other financial services disputes, replevins and seizure orders, lien priority contests, relief from stay and cash collateral proceedings, and dischargeability, preference avoidance and fraudulent conveyance actions.

Experience

Representative Matters
  • Acts as national coordinating counsel to large-scale equipment lessor and lender with respect to the client’s lease and lending litigation and bankruptcy matters, overseeing cases in state, federal district and bankruptcy courts throughout the country involving manufacturing, health care, transportation, energy and other industries.
  • Obtained dismissal of an automobile dealer’s Chapter 11 bankruptcy proceeding due to mismanagement of assets and violations of court orders concerning the use of cash collateral.
  • Obtained dismissal of a Chapter 11 bankruptcy proceeding on bad faith grounds premised on the unauthorized pre-petition transfer of real property.
  • Served as court-appointed referee in connection with the foreclosure and sale of a hotel property.
  • Successfully litigated a claim under the Fifth (Takings Clause) and Fourteenth (Due Process Clause) Amendments to the United States Constitution involving a county’s seizure and disposition of assets without proper notice to lienholders.
  • Represented a receiver in connection with U.S. Securities and Exchange Commission and Federal Trade Commission enforcement actions.
